1. Who we are. needaspare.com ("Spare," "we," "us") is operated by Humble Medical Supply, based in Casa Grande, Arizona. These Terms apply to your use of our website and any purchase you make from us (the "Services"). By using the Services or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy.
2. Eligibility. You must be at least the age of majority where you live to buy from us, or be shopping with the permission of a parent or guardian.
3. Our products. We sell factory-sealed, unused diabetes supplies. Our supply includes sealed surplus inventory from verified individual sellers. Every item is reviewed for product identity, packaging integrity, expiration date, recalls and condition before it's listed. Brand names belong to their owners. Spare is not affiliated with, endorsed by, or sponsored by any manufacturer.
4. Not medical advice. Nothing on our site, and nothing we say by phone, text or email, is medical advice. Our help choosing a product only identifies which box matches the one you already use. Talk to your doctor or pharmacist about your treatment, and follow the manufacturer's instructions for use. You are responsible for making sure a product is right for you and is used as directed.
5. Expiration dates and descriptions. We show the earliest expiration date we'll ship when it's logged. We try to describe products, photos and prices accurately, but mistakes can happen. If we find an error in an order, we'll contact you before it ships, and you can cancel for a full refund.
6. Orders, prices and payment. Prices are in U.S. dollars and may change at any time before you place your order. We may refuse or cancel any order, for example if stock runs out, a price was listed in error, or we suspect fraud. If we cancel after you've paid, we'll refund you in full. Payments are processed securely through Shopify and its payment providers.
7. Shipping, returns and refunds. Shipping is covered by our Shipping Policy. Returns, exchanges and refunds are covered by our Refund Policy. Early sensor or pod failures are handled through the manufacturer's replacement program.
8. Your account. If you create an account, keep your login details safe. You're responsible for activity on your account. Tell us right away if you think someone else has used it.
9. Acceptable use. Don't misuse the Services. For example, don't break the law, interfere with the site's security, scrape or copy the site, place fraudulent orders, or buy products for resale without our written permission.
10. Our content. The site's text, design, graphics and photos belong to us or our licensors. You may not copy or reuse them without permission.
11. Messages from us. If you give us your phone number or email, we'll use it for order updates and support. We'll only send you marketing emails or texts if you opt in. You can unsubscribe at any time, or reply STOP to any text. Message and data rates may apply.
12. Disclaimer. Apart from any warranty the manufacturer provides and anything the law doesn't let us exclude, the Services and products are provided "as is" and "as available," without other warranties of any kind.
13. Limitation of liability. To the fullest extent allowed by law, we're not liable for indirect, incidental, special or consequential damages. Our total liability for any claim is limited to the amount you paid for the order the claim relates to. Some places don't allow these limits, so they may not apply to you.
14. Indemnity. You agree to cover us for claims arising from your misuse of the Services or your breach of these Terms.
15. Governing law. These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Arizona, unless the law where you live requires otherwise.
16. Changes. We may update these Terms from time to time. The version posted on this page, with its "Last updated" date, applies to your use of the Services.
